General Terms and Conditions of deutSCHule GmbH

  1. Subject matter

These General Terms and Conditions apply for the entire business relationship between deutSCHule GmbH and its course participants and contractual partners. Differing terms and conditions of the contractual partner shall not apply.

  1. Conclusion of contracts

2.1    Registrations for a course can be made via the online shop on the deutSCHule website or the written registration form in the deutSCHule office. With an online application, a training contract with the course participant only comes about after confirmation (in writing or in text form Section 126 b Civil Code) by deutSCHule GmbH.

2.2    With online conclusion, training contract course participants have the right to revoke the training contract within 14 days without stating reasons. The revocation period is 14 days from the conclusion (binding order). To exercise the revocation right, the course participant has to inform deutSCHule (deutSCHule GmbH, Karl-Marx-Straße 107, 12043 Berlin, Fax: + 49 (0) 30 – 68085336; email: info@die-deutschule.de) about his decision to revoke this contract by means of a clear statement (e.g. a letter sent by post, fax or email). The course participant can use the model form provided online for this, but this is not obligatory, however. The revocation period is met if the course participant sends the notification about the exercising of the revocation right before the end of the revocation period. Consequences of revocation: If the course participant has revoked the contract in good time, deutSCHule shall reimburse the course participant all and any payments which deutSCHule has received from the course participant free of charge, without undue delay and at the latest within 14 days from the date on which the notification about the cancellation was received. deutSCHule will remit the repayment by the same means that the course participant used for the original transaction, unless expressly agreed otherwise.

2.3    The following training contracts can be concluded:

2.3.1 Visa contract (“Premium open”) – The registration for a course with an Visa contract is valid for 12 months. Within that period, the course participant has to register for a course period offered by deutSCHule at least three weeks before the start of the course. If there is available capacity, the course start chosen shall be confirmed by deutSCHule in text form. This contract can only be concluded with course participants who intend to request a visa for Germany. The start of the contract and its term will be determined in the individual contract. If there is no registration within the term of the contract, the paid course fees shall be forfeit without reimbursement. However the course fee (net of the registration fee and an administration fee of 19% of the agreed course fee) will be repaid upon proven refusal of a visa within the term of the contract. Repayment is also conditional on the course participant returning all the documents issued by deutSCHule to deutSCHule and also presentation of the visa refusal notification in the original in good time.

2.3.2 Standard contract (“Standard fixed”) – The registration for a course with a fixed contract is valid immediately upon effective conclusion of a contract.

2.3.5 Teaching Certificate – The registration for training towards a Teaching Certificate qualification is immediately valid with effective conclusion of a contract.

2.4    If the course participant does not attend a course or training course – regardless of the reason – the course fees shall be forfeited without reimbursement. Course interruptions or temporary suspension of participation during the course by the course participant is possible against payment of an administration fee of EUR 10.00/week for the duration of the interruption or suspension.

2.5    The price list and timetable posted on the website and displayed the deutSCHule office at the time the contract is concluded are definitive.

2.6    No teaching takes place on statutory public holidays. There are no school holidays.

  1. Terms of payment

With effective online conclusion of a contract, the agreed course or training fee is due in its entirety immediately and is to be paid by card on the deutSCHule business premises or remitted to the deutSCHule bank account stated in the confirmation within 14 days. Bank charges for transfers from abroad or for return transfers abroad shall be borne by the course participant. Where a contract is concluded on the deutSCHule business premises, the agreed course or training fee is to be paid immediately by EC/credit card.

  1. Cancellation/termination/rescission

4.1    Cancellation/termination/rescission of the effectively agreed course(s) is possible at any time. Cancellation/termination/rescission by the course participant has to be effected in writing or in text form (Section 126 b Civil Code). Cancellation/termination/rescission after the end of the revocation period (above 2.2) shall not affect the payment obligation subject to the proviso in Clause 4.2 below.

4.2    The course fee will only be reimbursed under a Visa contract subject to the conditions stated therein (2.3.1).

  1. Rebooking/contract prolongation

5.1    If there are insufficient course participants for a course (at least eight course participants), deutSCHule shall be entitled to rearrange the course.

5.2    The course participant is shall be entitled in liaison with deutSCHule to move the time at which his course starts against payment of an administration fee of EUR 9.00, if there are sufficient capacities in the chosen course.

5.3    Transfer of already paid course fees to another person is possible against payment of a 19% processing fee pro rata for the remaining time.

5.4    deutSCHule expressly reserves the right to change the course time (date or time), to change the responsible teacher or deploy an alternate in the event of illness. If the course has to be cancelled or postponed due to organisational circumstances, the entire course fees shall be reimbursed, unless the course participant rebooks his course. Claims for damages are excluded.

5.5    Every contract prolongation shall require an express contractual agreement; automatic contract prolongation is excluded. If the course participant attends a course for longer than contractually agreed, deutSCHule shall be entitled to invoice course fees for the exact number of days.

  1. Liability

6.1    deutSCHule shall not be liable for lessons cancelled due to force majeure. Participation in courses is at the participant’s own risk. The course participant shall be liable directly to those affected by harm of any nature caused the course participant in question.

6.2    deutSCHule refuses all and any liability for the member’s harm. Excluded herefrom is liability for breach of cardinal duties and also for harm arising from loss of life, injury or impairment of health due to a negligent breach of duty on the part of deutSCHule or an intentional or negligent breach of duty by a statutory representative or vicarious agent of deutSCHule and also liability for other harm arising from grossly negligent breach of duty by deutSCHule or an intentional or negligent breach of duty by a statutory representative or vicarious agent of deutSCHule.

  1. School and building rules and regulations

The school and building rules and regulations posted on the website and displayed in the deutSCHule office are binding. The course participant is obligated to heed the house rules and regulations.

  1. Data protection

deutSCHule collects, processes and uses the course participant’s personal data itself or through subcontracted service providers in so far as this serves the purpose of the contractual relationship or is required for the investigation of criminal offences. By concluding the training contract, the member consents to the aforementioned use of his data. Attention is drawn to the data protection policy posted separately on the Internet and displayed in the deutSCHule office.

  1. Miscellaneous

If any provision in these terms and conditions is or becomes void, this shall not affect the remaining provisions. In that event, the content of the void provision shall be governed by statutory regulations. This shall also apply accordingly in the case of a gap in the contract.

Addition to the General Terms and Conditions of die deutSCHule GmbH

 

Preamble

Due to the SARS-CoV-2 pandemic, die deutSCHule GmbH must implement a prevention and hygiene plan in accordance with the SARS-CoV-2 infection protection regulation of the Berlin Senate. The general terms and conditions of deutSCHule GmbH are therefore supplemented by the following provisions:

1. Basic duties

Every person on the premises is required to keep physical and social contact to other people as little as possible. Please keep a minimum distance of 1.5 meters when interacting with others.

2. Prevention and hygiene concept

The distance and direction markings on the floor and on the tables must be observed. Tables and chairs must not be moved. Please use the proper entrance and exit.

3. Mouth and nose covering

A mouth and nose covering must be worn in the stairwell, in the hallways, in the cafeteria, in the restrooms and in the classrooms.

4. Continuation of the courses

If the senate of Berlin, the public health office (“Gesundheitsamt”) or another public authority rules that in person courses can no longer meet, die deutSCHule GmbH will continue all running courses as online courses. All contracts will therefore remain valid until they expire.

5. Violations

Violations of the SARS-CoV-2 infection protection regulation will be reported. Please note that administrative offenses can be punished with a fine of up to 25,000 euros.

6. Validity

Points 1, 2, 3, 4 and 5 are part of the general terms and conditions of die deutSCHule GmbH until der SARS-CoV-2 infection protection regulation issued by the senate of Berlin expires.

* Reimbursement within the statutory revocation period of 14 days (in the case of online bookings). For compliance with the deadline requires only that the written declaration of revocation be sent prior to the deadline. The revocation period is uniformly 14 days and begins at the earliest when the course participant has received valid instructions regarding revocation.

** the originals of all documents issued by deutSCHule must be returned to deutSCHule within 12 months of being issued. In addition, the original of the notice of rejection must be presented to deutSCHule immediately after it has been received. After expiry of this deadline, all rights of redress and the fees that have already been paid shall lapse.
If no application for a visa has been made, deutSCHule must without fail be presented with other confirmation from the relevant embassy. Without such confirmation, reimbursement will not be possible!
